Hush Tell Us Ltd, a company headquartered in Glasgow (Scotland), owns and manages this website (hereinafter referred to as the “Website”).
The Website facilitates the provision of therapy sessions by licensed Service Providers, particularly therapists, who connect with users of the Website. Such therapy Sessions are provided exclusively by telephone, and not virtually. Hush Tell Us facilitates the provision of therapy Sessions by Providers that are bookable through the Website.
These Terms and Conditions govern the terms upon which Clients may purchase individual therapy Sessions and/or subscribe to therapy Sessions offered through the Website. These Terms and Conditions apply to all Clients upon access to or use of the Website, including the booking of therapy Sessions or the purchase of subscriptions.
In these Terms and Conditions, the following capitalized terms shall have the definitions set forth below:
“Clients” shall refer to all users of the Website who participate in Sessions through a one-time purchase or pursuant to a subscription, and “Client” shall refer to any individual such user.
“Content” shall refer to all content and sounds published on the Website. The Content shall be available to Clients, who use and access the Website.
“Dispute” shall refer to all disputes between a Client and Hush Tell Us arising out of or relating to these Terms and Conditions.
“Hush Tell Us” shall refer to Hush Tell Us Ltd.
“Providers” shall refer to all licensed therapists who offer and deliver Sessions to Clients through the Website.
“Sessions” shall refer to therapy sessions provided by Providers to Clients, which are delivered exclusively by telephone and booked through the Website.
“Terms and Conditions” shall refer to these Terms and Conditions and include updates made hereto from time to time.
Use of the Website by Client shall constitute the Client’s full acceptance of these Terms and Conditions.
These Terms and Conditions constitute a binding and enforceable agreement between Clients and Hush Tell Us. Clients acknowledge that Hush Tell Us shall not be bound by any other terms or agreements except for the present Terms and Conditions.
If a Client does not agree with these Terms and Conditions, in full or in part, their sole recourse shall be to not use the Website.
To use the Website and to participate in Sessions, each Client confirms the following to Hush Tell Us:
Hush Tell Us may update or modify these Terms and Conditions without notice, at Hush Tell Us’ discretion. The latest version of these Terms and Conditions shall be binding and effective upon its publication on the Website. Hush Tell Us recommends that all Clients read the Terms and Conditions periodically to ensure familiarity with the latest version.
Clients’ continued access to or use of the Website following the publication of updated Terms and Conditions shall constitute their acceptance of the updated Terms and Conditions.
All therapy Sessions offered through the Website are provided by Providers who are members in good standing of a recognised professional body for psychotherapists and other therapists, namely the United Kingdom Council for Psychotherapy (UKCP) and British Association for Counselling and Psychotherapy (BACP).
All Providers engaged by Hush Tell Us are based in the United Kingdom.
Providers are required to comply at all times with their applicable professional obligations, including obligations of confidentiality, record-keeping, and professional conduct.
Hush Tell Us engages in due diligence in the selection of Providers. Such due diligence processes may include, without limitation, personal interviews conducted, verification of professional qualifications, background checks where permitted by law, and reference verifications.
Providers shall share their names with Clients. Upon confirmation of a booking, Clients shall be notified by email of the name of the Provider who shall deliver the Session.
To the extent required by their professional orders, Providers shall take clinical notes and records as part of each Session or pursuant thereto. Providers shall be responsible for maintaining such notes in accordance with their professional, regulatory, and legal obligations. Hush Tell Us does not prescribe a fixed retention period for Providers’ clinical notes.
Such records shall be retained by the Providers for the duration required by applicable laws and regulations.
Therapy Sessions may be recorded for quality and compliance purposes, subject to applicable laws. Such calls may not be accessed by Hush Tell Us, and shall only be consulted in the following cases: (i) with the Client’s consent, (ii) to fulfill the requirements of a court order, or (iii) in case of a dispute or investigation. Hush Tell Us may discontinue call recording practices at any time if required by law or applicable regulations.
Clients shall be informed in advance of the recording, and such recording shall take place only with the Client’s knowledge, unless recording is otherwise required by law.
Recorded calls, where applicable, shall be securely stored and retained solely for as long as legally necessary to fulfil the purpose for which they were recorded, in compliance with applicable data protection laws.
Hush Tell Us reserves the right to discontinue call recording practices at any time.
All Providers are bound by professional duties of confidentiality and shall treat all Client information and communications as strictly confidential. Notwithstanding the foregoing, Providers may disclose confidential information relayed by a Client if required by applicable law or professional obligations.
The Sessions do not constitute an emergency service and are not intended to be used in crisis situations. The Sessions are designed to provide early, preventative mental health support and may form part of a Client’s broader approach to managing their mental health.
The Sessions are not suitable for individuals who are experiencing a mental health emergency or who are contemplating suicide or self-harm. If a Client is experiencing thoughts of suicide or self-harm, or otherwise requires immediate assistance, they must seek urgent help by contacting (i) their GP or treating healthcare professional; (ii) emergency services (999); or (iii) Samaritans (available in the UK).
By booking Sessions, Clients agree that the Sessions are not an emergency or crisis service and that Clients are responsible for seeking appropriate urgent or emergency support where required.
When a Client books a Session, the Client shall receive an email confirming the booking and identifying the Provider assigned to deliver the Session.
At this time, Clients are not able to book or select a specific Provider. The assignment to a Provider shall be made at Hush Tell Us’ discretion.
Following the booking, the Provider shall contact the Client within a reasonable time frame to schedule the Session. Contact may take several days and may be delayed due to weekends, public holidays or availability. A booking shall not result in an instant Session, and should not be construed as an emergency service.
One-off Sessions must be rescheduled upon providing at least forty-eight (48) hours’ notice. If a Client fails to provide the required notice or does not attend a scheduled Session, the Session shall be deemed a missed appointment, shall not be refunded or credited. The Client shall be responsible for purchasing and scheduling a new Session.
Hush Tell Us reserves the right, at its sole discretion, to suspend or terminate a Client’s access to Sessions if the Client breaches these Terms and Conditions.
Sessions may be individually purchased, or subject to a subscription.
Hush Tell Us offers subscriptions for purchase through the Website. Each subscription includes three (3) thirty (30) minute Sessions per month, or three (3) sixty (60) minute Sessions per month. Clients are responsible for attending all scheduled Sessions. Any missed Sessions shall not be carried over to the next month. Any missed Sessions shall further not be subject to a refund.
For Clients with active subscriptions, Sessions are scheduled in advance with the assigned Provider.
The subscription shall allow the Client to benefit from the predetermined Sessions during each month of the subscription period. Clients shall be responsible for the payment of the subscription fees purchased for the duration selected.
The subscription fees are a fixed fee, payable on a monthly basis. Hush Tell Us shall charge on a monthly basis once the subscription term has commenced.
Unless otherwise specified in the subscription confirmation and unless cancelled or terminated by the Client prior to the renewal, the subscription shall automatically renew for subsequent one (1) month periods. The subscription shall remain in effect until (a) the Client fails to pay the subscription fees on their due date, or (b) the Client cancels the subscription in accordance with these Terms and Conditions.
The Client may cancel their subscription, upon providing a one (1) month notice, by sending an email to hushtherapists@hotmail.com. The subscription shall be cancelled as of the last day of the Subscription’s current term, unless otherwise specified in the cancellation confirmation provided by Hush Tell Us.
Once the subscription is effectively cancelled, the Client shall no longer benefit from the predetermined Sessions subject to the subscription. The Client’s payment information shall cease to be billed on the effective cancellation date. Please note that Hush Tell Us shall not refund fees already paid for subscription services.
Clients may purchase individual Sessions through the Website’s services and pricing section. All Sessions shall be paid in full in advance. Failure to pay for a Session or subscription in advance shall result in cancelled Sessions. Any cancelled or missed Sessions shall not give rise to a refund.
When proceeding with an individual purchase or a subscription, Clients shall be required to share personal information, which may include their names, email addresses, telephone numbers and payment information. All payment information, such as credit card or other payment method used, shall be collected and stored by Hush Tell Us’ third-party payment processor. At this time, Hush Tell Us works exclusively with Stripe. Hush Tell Us does not store nor collect Clients’ payment information.
Clients agree that their use of the Website and Sessions must comply with all applicable laws, regulations, policies and standards. Any fraudulent, abusive or illegal use of the Website and Sessions is strictly prohibited.
Clients are responsible for their actions and omissions while using the Website. Clients shall not engage in prohibited activities, such as:
Unless otherwise explicitly stated, Hush Tell Us owns the Content published on the Website, or has secured valid licenses to publish the Content on the Website. Any Content that has been licensed to Hush Tell Us remains the property of its respective owners. The Content published on the Website may be protected by intellectual property laws. All rights relating thereto are reserved.
Clients are permitted to copy and use the Content on the Website for personal, non-commercial use and reference purposes. Clients are not authorized to use the Content on the Website for commercial or business purposes. Clients agree not to reproduce, copy, edit, modify, distribute, transmit or otherwise share the intellectual property and Content on the Website with any third party without the prior written consent of Hush Tell Us.
Where a concern, complaint, or issue arises between a Client and a Provider, or where a Client wishes to work with a different Provider, the Client agrees that relevant information relating to the matter may be shared internally for the purposes of Hush Tell Us reviewing, managing, and resolving the issue appropriately.
Any complaints regarding a Provider must be submitted in writing to Hush Tell Us by email hushtherapists@hotmail.com.
Hush Tell Us seeks to address and resolve all complaints promptly, fairly and amicably. In the assessment of a complaint, Hush Tell Us may request additional information.
Hush Tell Us may then take such action as it deems appropriate, which action may consist of changing Providers, or ending Sessions or terminating the therapeutic relationship.
While Hush Tell Us shall use reasonable efforts to assist in resolving complaints, Hush Tell Us cannot guarantee any particular outcome. To the fullest extent permitted by law, Hush Tell Us shall not be liable for disputes arising between a Client and a Provider, provided Hush Tell Us acted in good faith in compliance with these Terms and Conditions.
The Website is intended for Clients located in the United Kingdom. Hush Tell Us does not represent or guarantee that the Website shall be appropriate or available to Clients located outside of the United Kingdom. Clients who do not reside in the United Kingdom recognise that the Sessions may not be available or suitable in regions outside the United Kingdom.
Hush Tell Us reserves the right to make changes to the Website, including, without limitation, updating Content.
Clients acknowledge that the information published on the Website may become outdated from time to time. Hush Tell Us makes no warranties or guarantees regarding the accuracy, validity, currency, or reliability of any Content published on the Website.
Clients acknowledge that any links to third-party websites or applications provided on the Website are for reference purposes only. Any third-party websites, or applications referenced on the Website are independent third parties to Hush Tell Us.
The inclusion of links on the Website does not imply Hush Tell Us’ endorsement or association with such third-party sites. Additionally, the publication of the links, images, logos, and referrals on the Website shall not be construed as Hush Tell Us’ affiliation with the same.
Hush Tell Us shall not be responsible for the accuracy, availability, or content of any third-party websites or applications. The use of the third-party links shall be subject to the third-party’s policies and specific terms, and not the present Terms and Conditions.
To the fullest extent permitted by law, each Client agrees to indemnify and hold harmless Hush Tell Us and its employees, agents, officers, directors and consultants from and against all losses, damages, liabilities, costs and expenses in connection with any claims, actions, proceedings, investigations or suits brought by a third party, arising out of the Client’s (i) use of the Website and/or the Session; (ii) breach of any agreement or obligation specified in these Terms and Conditions; and/or (iii) false, misleading or incomplete representation or warranty in connection with these Terms and Conditions.
Hush Tell Us shall not be liable for any suspension, termination, service downtime, technical issues, delays or loss of access to the Website. Hush Tell Us shall not be liable for service interruptions affecting the Website, delays caused by third-party systems or maintenance.
Known and documented risks are associated with online activity. Hush Tell Us does not guarantee that technical issues or defects shall be corrected in a timely manner or even corrected at all.
To the fullest extent permitted by applicable law, Hush Tell Us shall not be liable to Clients for any indirect, special or consequential losses or damages arising from access and/or use of the Website and Sessions, including but not limited to loss of profits, opportunity, revenue, privacy, business or anticipated earnings. This exclusion of liability shall apply even if Hush Tell Us was notified of the possibility of such damages arising.
Hush Tell Us shall not be responsible for any damages, losses, delays or other injuries caused by a Force Majeure event. Force Majeure events are acts of God, epidemics, pandemics, acts of war, terrorist activities of any kind, natural disasters or other circumstances beyond Hush Tell Us’ reasonable control.
If Hush Tell Us is delayed or prevented from performing any obligation or act required by these Terms and Conditions by reason of a Force Majeure event, Hush Tell Us shall be relieved of its obligation to perform during the Force Majeure event. Hush Tell Us obligation may resume once the Force Majeure event has resolved or otherwise terminated.
The Website is provided “as is”, without any warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by applicable law, Hush Tell Us expressly disclaims all warranties and conditions, including but not limited to: (a) implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement; (b) warranties arising from course of dealing or usage of trade; and (c) liability for the acts, omissions, or conduct of any third parties on or through the Website.
Clients acknowledge that the Sessions are provided by Providers, and not by Hush Tell Us. Hush Tell Us has no control over, and assumes no liability for, the operation, availability, or inaccessibility of the Providers.
The availability of specific Providers is not guaranteed and may vary based on location, supplier availability, or third-party policy changes. Hush Tell Us reserves the right to cease collaborating with certain Providers.
Hush Tell Us makes no representations or warranties regarding the accuracy, completeness, or reliability of the advice provided by Providers during or as part of Sessions. In addition, Hush Tell Us does not provide any guarantees regarding the quality, usability, or performance of the Providers.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland (excluding any conflict of laws principle which refers to the laws of another jurisdiction).
In case of any Dispute, Clients shall make reasonable efforts to resolve the Dispute informally and amicably, including by means of a conference. In good faith, Clients shall make commercially reasonable efforts to resolve the Dispute.
If the Dispute cannot be resolved informally within a reasonable period, the Client and Hush Tell Us agree that the competent courts of Scotland shall have the exclusive jurisdiction, subject to the Client’s statutory consumer rights.
Nothing in these Terms and Conditions shall limit or exclude a Client’s right to bring a claim before a court or tribunal of competent jurisdiction where such right cannot lawfully be restricted.
All proceedings introduced to resolve Disputes shall be on an individual basis, and not class actions. Accordingly, Disputes shall be brought in the Client’s individual capacity, and not as part of a class action or another Dispute.
Hush Tell Us may assign all or part of its rights and obligations hereunder to any third-party. Clients may not assign their rights and obligations under these Terms and Conditions, except with Hush Tell Us’ prior written approval.
No waiver by Hush Tell Us, whether by conduct or otherwise, of any of these Terms and Conditions shall be enforceable, except if such waiver is provided in a duly executed written instrument by Hush Tell Us.
Written communications help ensure that requests can be properly tracked and processed by Hush Tell Us. Any notice, consent or other communication required by these Terms and Conditions shall be provided in writing and delivered using any delivery method with proof of receipt to Hush Tell Us’ headquarters, as noted below:

If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court of law, the provision shall be severed from these Terms and Conditions. The remaining provisions shall remain effective and binding.
These Terms and Conditions, together with any policies named herein, shall constitute the full agreement between Clients and Hush Tell Us with respect to the subject matter hereof, and supersede all previous negotiations and agreements between Clients and Hush Tell Us regarding the subject matter hereof.
